But, coming as it does in a period of popular scepticism about expertise, there is a risk that the legislation will miss a significant opportunity.聽</div>&#13; &#13; <div>聽</div>&#13; &#13; <div> 探花直播recent debates in Parliament have paid little attention to the question of what a university is for. To the extent that it has been considered at all, the answer has been assumed to be confined to teaching and research. Indeed, the text of the Bill suggests that this is also the sum total of what the Government believes universities to do: in short, matters which can be conveniently assessed by the teaching and research excellence frameworks.聽</div>&#13; &#13; <div>聽</div>&#13; &#13; <div>But, bearing in mind that one of the key aims of the Bill is to open up higher education to new providers, it is vital that Parliament gives more careful consideration to the issue of what kinds of institutions merit being given degree-awarding powers.聽</div>&#13; &#13; <div>聽</div>&#13; &#13; <div>While education and research are both vital components, there is more to a university than this. 探花直播additional element relates to outward-facing public engagement and discussion. In the wake of the denigration of the views of 鈥渆xperts鈥 by certain supporters of the Trump and Brexit campaigns, the need for universities, and those who work in them, to challenge and criticise publicly is more important than ever.聽</div>&#13; &#13; <div>聽</div>&#13; &#13; <div>An important attempt to define the essence of a university has already been undertaken in legislation in New Zealand. Its <a href="http://www.legislation.govt.nz/act/public/1989/0080/latest/DLM183668.html">1989 Education Act (section 162(4)(a))</a> lists five characteristics that an institution must possess before it can be recognised as a university. As well as those relating to teaching and research, the fifth requires the institution to accept 鈥渁 role as critic and conscience of society鈥.聽</div>&#13; &#13; <div>聽</div>&#13; &#13; <div>I believe that very similar wording should be incorporated into English law. Concern has been expressed in the sector and in the debates about the Bill that it will infringe institutional autonomy and interfere with academic freedom. Although the minister, <a href="https://www.timeshighereducation.com/comment/higher-education-and-research-bill-its-matter-trust">Jo Johnson, has insisted that the concerns are misplaced</a>, some scepticism remains. A significant and simple way of responding to it would be to recognise the legal responsibility of a university to act as critic and conscience of society.聽<img alt="" src="/files/inner-images/1469400828500.jpg" style="width: 250px; height: 250px; margin: 5px; float: right;" /></div>&#13; &#13; <div>聽</div>&#13; &#13; <div>This would not involve the imposition of any legally enforceable duties. Instead, it would acknowledge the justifiable expectation of the state that universities should make a vital contribution to society.</div>&#13; &#13; <div>聽</div>&#13; &#13; <div>Academics already have a responsibility to speak to correct error and prejudice, whether it is the scientist rebutting climate-change scepticism, the classicist challenging unfounded interpretations of ancient history or the lawyer correcting media misunderstanding of the implications of a judicial decision about the royal prerogative and parliamentary sovereignty. And, with the prevalence of social media, this responsibility could not be easier to fulfil.聽</div>&#13; &#13; <div>聽</div>&#13; &#13; <div>But a 鈥渃ritic and conscience鈥 clause would mean that institutions must encourage those working in them to engage in public discussion and embrace the freedom to develop new ideas, test received wisdom and examine controversial and unpopular positions. It would also oblige universities to support staff if they were subject to illegitimate criticism for doing so.聽</div>&#13; &#13; <div>聽</div>&#13; &#13; <div>Further, although the recent threat of UK researchers being gagged by the Government鈥檚 adoption of an <a href="https://www.timeshighereducation.com/news/anti-lobbying-clause-no-intention-to-apply-it-to-academics">anti-lobbying clause</a> has passed, that possibility could not have been seriously contemplated in the first place had there been a 鈥渃ritic and conscience鈥 clause in legislation, since the responsibility of researchers to speak out about the implications of research for society would have trumped any possibility of their being silenced under the guise of anti-lobbying.聽</div>&#13; &#13; <div>聽</div>&#13; &#13; <div>Crucially, such a clause would also mean that new higher education providers would need to acknowledge explicitly their external-facing responsibilities. For image use please see separate credits above.</p>&#13; </div></div></div><div class="field field-name-field-show-cc-text field-type-list-boolean field-label-hidden"><div class="field-items"><div class="field-item even">Yes</div></div></div> Fri, 06 Jan 2017 11:00:00 +0000 ta385 183032 at Protecting our data and identity: how should the law respond? /research/features/protecting-our-data-and-identity-how-should-the-law-respond <div class="field field-name-field-news-image field-type-image field-label-hidden"><div class="field-items"><div class="field-item even"><img class="cam-scale-with-grid" src="/sites/default/files/styles/content-580x288/public/news/research/features/161026what-are-you-looking-atnolifebeforecoffee.jpg?itok=q1gEXxLF" alt="" title="Banksy stencil, Credit: nolifebeforecoffee" /></div></div></div><div class="field field-name-body field-type-text-with-summary field-label-hidden"><div class="field-items"><div class="field-item even"><p> 探花直播freedom of expression and the need for privacy may be strange bedfellows today 鈥 but could full-blown estrangement beckon in a digital future that makes the leap from user-controlled content to unfiltered, online sharing of, well, everything?</p> <p>A future where streaming your life online becomes the norm is not unthinkable, according to Dr David Erdos, whose research in the Faculty of Law explores the nature of data protection. 鈥淭ake something like Snapchat Spectacles or Google Glass,鈥 he says. 鈥淪uch technology could very quickly take off, and all of a sudden it becomes 鈥榥ormal鈥 that everyone is recording everything, both audibly and visually, and the data is going everywhere and being used for all sorts of purposes 鈥 some individual, some organisational.鈥</p> <p>This makes questions about what control we have over our digital footprint rather urgent.</p> <p>鈥淵ou can see that we need to get some grip on how the right to privacy can be enforced as technologies continue to develop that can pose serious threats to individuals鈥 sense of dignity, reputation, privacy and safety,鈥 he adds.</p> <p>One enforcement Erdos refers to is <em>Google Spain</em>, a ruling made in 2014 by the Court of Justice of the European Union (CJEU) that examined search engines鈥 responsibilities when sharing content about us on the world wide web.</p> <p> 探花直播CJEU ruled that people across all of the 28 EU Member States have a 鈥榬ight to be forgotten鈥 online, giving them an ability to prohibit search engines indexing inadequate, irrelevant or other illegal information about them against their name.聽This right to be forgotten is based on Europe鈥檚 data protection laws and applies to all online information about a living person.</p> <p>Google responded by publishing a form you can submit to have such links to content (not the actual content) removed. I put it to the test 鈥 Google refuses on the basis that web links to my long-closed business are 鈥焜ustified鈥 as they 鈥焟ay be of interest to potential or current consumers鈥.</p> <p>Erdos explains that data protection doesn鈥檛 always work as it was originally intended to. 鈥淥n paper, the law is in favour of privacy and the protection of individuals 鈥 there are stringent rules around data export, data transparency and sensitive data, for example.</p> <p>鈥淏ut that law was in essence developed in the 1970s, when there were few computers. Now we have billions of computers, and the ease of connectivity of smartphones and the internet.聽 Also, sharing online is not practically constrained by EU boundaries.</p> <p>鈥淭hat means the framework is profoundly challenged. There needs to be a more contextual legal approach, where the duties and possibly also the scope take into account risk as well as the other rights and interests that are engaged.聽 That law must then be effectively enforced.鈥</p> <p>In fact, the EU data protection law currently extends surprisingly far. 鈥淏y default, the law regulates anyone who alone, or jointly with others, does anything with computerised information that mentions a living person,鈥 Erdos explains. 鈥淭hat could include many individuals on social networking sites. If you鈥檙e disseminating information about a third party to an indeterminate number of people, you鈥檙e (in theory at least) responsible for adherence to this law.鈥</p> <p>Tweeters, for instance, may have to respond to requests for data (Tweets) to be rectified for inaccuracy or even removed entirely, and field 鈥榮ubject access requests鈥 for full lists of everything they鈥檝e Tweeted about someone. And under the new General Data Protection Regulation that comes into effect in 2018, the maximum penalty for an infringement is 鈧20 million (or, in the case of companies, up to 4% of annual global turnover).</p> <p>When it comes to search engines or social media, Erdos admits that a strict application of the law is 鈥渘ot very realistic鈥. He adds: 鈥淭here鈥檚 a systemic problem in the gap between the law on the books and the law in reality, and the restrictions are not desperately enforced.鈥</p> <p>Erdos believes inconsistencies in the law could be exploited online by the ruthless. 鈥 探花直播very danger of all-encompassing, stringent laws is that it seems as if responsible organisations and individuals who take them seriously are hamstrung while the irresponsible do whatever they want.鈥</p> <p>This also applies to 鈥榙erogations鈥 鈥 areas where the law instructs a balance must be struck between data protection and the聽rights to freedom of journalistic, literary and artistic expression.</p> <p>鈥淢ember states have done radically different things in their formal law here 鈥 from nothing at all through to providing a blanket exception 鈥 neither of which was the intention of the EU scheme.鈥</p> <p>As the new law in 2018 will empower regulators to hand out fines of up to hundreds of millions of euros to large multinational companies, Erdos is passionate about the urgency of Europe getting a coordinated and clear approach on how its citizens can exercise their data protection rights.</p> <p>鈥淲e are giving these regulators quite enormous powers to enforce these rules and yet do we have a good understanding of what we want the outcome to be and what we鈥檙e expecting individuals and organisations to do?鈥 Erdos ponders.</p> <p>鈥淭o me, this means that the enforcement will become more and more important. Data protection is not just a technical phrase 鈥 people really do need protection. 探花直播substance of the law needs to be hauled into something that鈥檚 more reasonable. That protection needs to be made real.鈥</p> <p>Erdos鈥 research also explores the nature of data protection and academic freedom, and he successfully argued for academic expression to be added to the list of free speech derogations in the 2018 legislation. 鈥淚 have come across the most egregious examples of research guidance stipulating alleged data protection requirements, including claims that published research can鈥檛 include any identifiable personal data at all,鈥 says Erdos.</p> <p>鈥淚n a survey of EU data protection authorities, I asked whether a journalist鈥檚 undercover investigation into extremist political beliefs and tactics and an academic鈥檚 undercover research into widespread claims of police racism could be legal under data protection. Not one regulator said the activity of the journalist would in principle be illegal, but almost half said the academic鈥檚 activity would be unlawful.</p> <p>聽鈥淎cademics aim to write something of public importance, and make it rigorous. 探花直播old law was seen to prioritise even tittle-tattle in a newspaper over academic research; one hopes this will largely be removed by the new law.鈥</p> <p>For many, the greatest concern remains the potential threats to their privacy. In order for consumers to feel safe with emerging technology, law makers may have to legislate for potential breaches now, rather than react after the damage is done.</p> <p>鈥淲e don鈥檛 want to respond in a panic of registering or documenting everything, but the alternative of collapse into an 鈥榓nything goes鈥 situation is equally dangerous.</p> <p>鈥淎pps like Snapchat show many people value being able to upload certain pictures and information that soon disappear. We don鈥檛 want people forgetting what they鈥檙e sharing today, and then worrying far too late how third parties are using that information.鈥</p> <p>Would Erdos himself ever use Snapchat Spectacles or Google Glass (he does own a smartphone)? He laughs. 鈥淟et鈥檚 face it, email, the internet, Google search鈥 people ended up having to use them.
